Yun Enterprises, Ltd. (Yun) appeals from: 1) a final summary judgment in favor of Graziani and Menicucci, doing business as BLT Hospitality (BLT) in an action for fraud and breach of contract and 2) the denial of Yuns motion for rehearing and to amend its complaint. We agree the documents Yun attached to its complaint were insufficient to establish the existence of a contract between the parties and the trial judge was correct to enter summary judgment for BLT. However, under the circumstances of this case, we think the trial judge should have given Yun an opportunity to amend its complaint at least once, given its belated showing of executed documents which may establish a contract.
